PLAY SOLANA - CLAIMS OF INFRINGEMENT (DMCA & DSA)
At Play Solana, we take the protection of intellectual property and compliance with digital regulations seriously. The Play<Gate> portal and the wider Play Solana ecosystem allow third-party publishers and developers to distribute games and related content. Because content is created and uploaded by third parties, there may be occasions where someone believes that material available through Play<Gate> is unlawful or infringes their copyright.
To handle these situations properly and fairly, Play Solana follows both:
United States (DMCA). Under the Digital Millennium Copyright Act (17 U.S.C. §512, “DMCA”), online platforms like Play<Gate> are protected from liability for third-party content as long as we provide a clear process to receive and act on copyright infringement notices. For this, Play Solana will designate an official U.S. DMCA Agent through the Copyright Office.
European Union (DSA). For users in the European Union, Play Solana complies with the Digital Services Act (Regulation (EU) 2022/2065, “DSA”). This law requires us to provide an accessible way for anyone to report illegal content (not only copyright, but also fraud, hate speech, scams, etc.), and to explain how those reports are handled. Our appointed legal representative in the EU is: AIO Studio LDA – Avenida D. João IV, Centro Comercial, Loja Villa 9, 4810-532 Guimarães, Portugal.
This unified policy outlines the process for reporting infringement or illegal content, the required information, and our response procedures. It is applied globally, without prejudice to additional rights or obligations that may arise under local laws in other jurisdictions.
For Play Solana to process a notice under the Digital Millennium Copyright Act (17 U.S.C. §512) or the Digital Services Act (Regulation (EU) 2022/2065, Art. 16), the notification must contain all of the following elements:
Identification of the specific content claimed to be illegal or infringing, including information reasonably sufficient to permit Play Solana to locate the material (such as the exact URL(s), the Play<Gate application identifier, or other unique locator within the Play Solana ecosystem).
Identification of the work or right claimed to have been infringed:
For copyright: the copyrighted work or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
For other unlawful content: the legal interest, provision, or right alleged to be violated (for example: fraud, unlawful gambling, hate speech, consumer protection infringement).
Legal basis of the complaint, specifying the law or right allegedly infringed. Under the DMCA, this must identify copyright infringement. Under the DSA, this may also include other categories of illegal content as defined by applicable EU or national law.
Information sufficient to permit Play Solana to contact the complaining party, such as the full legal name, mailing address, telephone number, and a valid email address.
A good-faith statement by the complaining party that they have a bona fide belief that the use of the material in the manner complained of is not authorized by the rights holder, its agent, or the law.
A statement of accuracy and authority confirming that the information in the notification is accurate and complete.
A physical or electronic signature of the complaining party or of a person authorized to act on their behalf. An electronic signature may be provided by typing the full legal name into the designated field in the Play Solana form.
EU (DSA). If your content has been removed or access disabled under the Digital Services Act, you may file an appeal through Play Solana’s appeal form. We will review appeals without undue delay, and in any event within a reasonable timeframe, and will notify you of the outcome. You also have the right to seek resolution through certified out-of-court dispute settlement bodies under Article 21 of the DSA.
US (DMCA). If your content has been removed in response to a DMCA notice, you may submit a counter-notice that includes:
Identification of the material removed and the location where it appeared before removal;
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the district where you are located (or, if outside the United States, for any judicial district in which Play Solana may be found), and that you will accept service of process from the party that submitted the original notice or their agent;
Your physical or electronic signature.
Once a valid counter-notice is received, Play Solana may restore the content in accordance with §512(g) of the DMCA unless the complaining party notifies us that it has filed a court action seeking to restrain the allegedly infringing activity.
Play Solana takes misuse of this process seriously. Submitting notices or counter-notices that are materially false, incomplete, or abusive may result in liability under applicable law, including:
DSA Article 16(5) (prohibition of abusive or manifestly unfounded notices); and
DMCA §512(f) (liability for misrepresentation in notices or counter-notices).
Repeat infringers. In appropriate circumstances, Play Solana may disable or terminate accounts of users or publishers who are repeatedly found to infringe or are repeatedly subject to valid complaints.

Play Solana has adopted a policy to disable and/or terminate, in appropriate circumstances, the accounts of publishers or users who are found repeatedly to infringe, or who are repeatedly subject to valid claims of infringement. As part of implementing this policy, Play Solana may, at its sole discretion, suspend, disable, and/or terminate accounts of users or publishers identified as repeatedly engaging in infringing or unlawful activities, or for other related reasons.
