These are the terms and conditions for the deposit and waitlist agreement related to the pre-order of gaming devices available at https://playsolana.com.
By placing a deposit for a product from Play Solana, you ("User") accept and agree to be bound by these Deposit and Waitlist Agreement Terms and Conditions ("Agreement"). In these terms and conditions, the words "we", "us", "our", and "Play Solana" refer to Play Solana, and "you" and "user" refer to you, the user of Play Solana. Our Privacy Policy is an integral part of this agreement.

This Agreement sets out the legally binding terms for your pre-order of a gaming device. By placing a deposit, you agree to be bound by this Agreement. If you do not agree to these terms, you must not place a deposit and should cease using the services immediately. We may modify this Agreement from time to time, and such modifications will be effective upon posting on the website. You agree to be bound by any modifications when you place a deposit after such changes are posted, so please review this Agreement regularly.
The gaming device ("Product") is currently available for pre-order. Play Solana does not guarantee availability or delivery dates, as production timelines may vary.

The deposit made under this Agreement is non-cancellable and non-refundable, as outlined in Section 9 below. This deposit serves as a reservation for a potential future purchase of the Product from Play Solana. The pricing of your Product is based on expected features and options available at the time you place your order.
Please note that any features or options that are updated or introduced after your order may not be available in the final Product.
Although the deposit is non-refundable, you are not obligated to proceed with the purchase of the Product. In the event that we issue a full refund of your deposit, we hold no responsibility to provide you with the Product.
This Agreement does not create a binding sales contract for the Product and does not guarantee pricing, a secure production slot, or a specific delivery date.
The purchase price is currently unknown. The purchase price of the Product does not include taxes or official fees, which will be calculated closer to the time of delivery and indicated on your Final Price Sheet. You are solely responsible for paying these additional taxes and fees.
The pre-order for the Product is open to anyone on a first-come, first-served basis. To secure your pre-order, you must pay a deposit of two hundred and ninety-nine (299) USD ("Deposit") and submit certain personal information ("Registration Information"). By reserving your spot, you agree to be charged the non-cancellable and non-refundable Deposit.
Please note that completing the pre-order process does not guarantee you a Product, as availability is based on the order of reservations received. You will be notified of your position in the order queue and any additional steps you may need to take.
To reserve your spot, you must connect a compatible digital wallet to our website and select one of the accepted payment methods. You have the option to make your payment either through cryptocurrency via Solana Pay or through fiat currency via PayPal.
Play Solana prioritizes the security of your payment information, and you can find detailed information about how we handle and protect your data in our Privacy Policy.
Play Solana is not liable for any losses or damages resulting from user errors related to your Deposit, including but not limited to incorrectly constructed transactions or mistyped addresses.
We will notify you when your Product is ready for shipment. Upon receiving this notification, you agree to promptly provide us with the following: (1) the remaining balance owed on the purchase price and (2) your shipping, wallet, and contact information. If you fail to respond within thirty (30) days of our notification, we reserve the right to cancel your order and retain your Deposit.
Title and risk of loss for the Product will pass to you upon its transfer to the third-party carrier. Once the Product is in transit, Play Solana will not be liable for any claims related to damage or loss of the Product during shipping.
Please be aware that shipping and delivery dates provided are estimates only and are not guaranteed. While we strive to meet these estimated timelines, we cannot be held liable for any delays, disruptions, or failures in the delivery process. You acknowledge and accept that circumstances beyond our control may affect shipping times, and you waive any right to claims against Play Solana for delays that may occur.
In the event that you have (i) paid the Deposit, (ii) provided the required Registration Information, (iii) completed the Final Payment, and (iv) supplied the necessary shipping information, and if the Product will not be produced, you will be entitled to a refund of your Deposit.
Refunds will be issued only in the original form of payment used at the time of the transaction. Please note that, except as specifically set forth in this Agreement, your Deposit is generally non-refundable.
To the fullest extent permitted by applicable law, in no event shall Play Solana be liable for any incidental, special, indirect, or consequential damages, including but not limited to loss of profits, data, or use, arising out of or in connection with this Agreement or your use of the Product. This limitation applies regardless of whether such damages are based on warranty, contract, tort (including negligence), or any other legal theory, and even if Play Solana has been advised of the possibility of such damages.
Furthermore, you agree to indemnify, defend, and hold harmless Play Solana, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your violation of this Agreement, your use or misuse of the Product, or any breach of your representations and warranties set forth herein. This indemnification obligation shall survive the termination of this Agreement.
Any dispute arising from or relating to this Agreement shall be resolved by binding arbitration in accordance with the rules of the relevant arbitration organization. You and Play Solana agree that any disputes shall be resolved on an individual basis and not in a class or representative action.
This Agreement shall be governed by and interpreted in accordance with the laws of the RAK DAO Freezone. Any disputes arising from or related to this Agreement, including its validity, interpretation, or enforcement, shall be exclusively submitted to the competent courts located within the RAK DAO Freezone. The parties hereby consent to the jurisdiction of such courts and waive any objections to the venue on the grounds of forum non conveniens or any similar doctrine.
YOU HEREBY ACKNOWLEDGE AND AGREE TO RESOLVE ANY DISPUTES EXCLUSIVELY THROUGH ARBITRATION OR IN THE DESIGNATED COURTS, AND FURTHER DISCLAIM ANY RIGHT TO FILE A LAWSUIT IN CONNECTION WITH THIS AGREEMENT, EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS AGREEMENT.
